Tesla has been handed a win by a U.S. appeals court, with an appeals court this week ruling that the company can legally dispute Louisiana’s ban on direct vehicle sales.
On Monday, the New Orleans-based 5th U.S. Circuit Court of Appeals sided with Tesla on its ability to sue the state over the direct-sales ban, according to a report from Reuters. The ruling was made in a 2-1 decision by the court, both vacating the dismissal of Tesla’s antitrust claim against the state and reversing the company’s due process claims. The decision also upholds the dismissal of equal protection claims from Tesla.
Essentially, the ban on direct vehicle sales forces automakers to sell to consumers through a franchised dealership model—something that Tesla and some other electric vehicle (EV) makers don’t have.

Tesla announced a lawsuit against Louisiana over the ban in 2022, after the Motor Vehicle Commission tried to prevent Tesla from providing warranty repairs at the New Orleans Service Center.
Dealerships and the state have attempted to prevent the company from suing or appealing the requirement since its lawsuit was launched. In the past, the automaker has also argued that, although it doesn’t sell vehicles through dealerships, it should still be allowed to lease and service Tesla vehicles owned by Louisiana residents.
Last October, the U.S. Department of Justice (DOJ) also backed Tesla when it claimed that the antitrust case’s dismissal had been done “improperly,” restricting antitrust law. The decision was made just months after the case had been dismissed by a federal court.
Tesla also faces multiple ongoing direct sales cases in other states.
Earlier this month, the company was granted a license to sell vehicles directly in Kentucky, after the state previously had a similar dealership model. Tesla immediately began hiring for a number of roles in Louisville, and plans to build a store and service center in the city have been rumored.
